These Terms apply to all users of the Service, including users who are also contributors of Content. "Content" includes the text, comments, posts, software, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, interactive features and other materials you may view on, access through, or contribute to the Service. The Service includes all products, software and services offered via the ThinkRight website or mobile application.

The Service may contain links to third-party websites that are not owned or controlled by ThinkRight.me. ThinkRight has no control over, and assumes no responsibility for, the content, privacy policies or practices of any third-party website. By using the Service you expressly relieve ThinkRight from any and all liability arising from your use of any third-party website.

To access some features of the Service you will have to create a ThinkRight account. You shall never use another person's account without permission. When creating your account you must provide accurate and complete information, and you must notify ThinkRight immediately of any breach of security or unauthorised use of your account.

Although ThinkRight will not be liable for losses caused to you by any unauthorised use of your account, you may be liable for the losses of ThinkRight or others due to such unauthorised use.

ThinkRight grants you permission to access and use the Service as set out in these Terms, provided that:

• You agree not to distribute in any medium any part of the Service or the Content without ThinkRight's prior written authorisation, unless ThinkRight makes available the means for such distribution through functionality offered by the Service.
• You agree not to alter or modify any part of the Service.
• You agree not to access Content through any technology or means other than the playback pages of the Service itself, the embeddable player, or other explicitly authorised means.
• You agree not to use the Service for commercial uses — including the sale of access to the Service, or the sale of advertising, sponsorships or promotions placed on or within the Service or Content — without ThinkRight's prior written approval.
• You agree not to use or launch any automated system, including "robots", "spiders" or "offline readers", that sends more requests to ThinkRight servers than a human can reasonably produce using a conventional browser.
• You agree not to collect or harvest any personally identifiable information from the Service, nor to use its communication systems for commercial solicitation.
• In your use of the Service, you will comply with all applicable laws.

ThinkRight reserves the right to discontinue any aspect of the Service at any time without giving reasons for such discontinuance.

The Content on the Service, and the trademarks, service marks and logos on the Service, are owned by or licensed to ThinkRight, subject to copyright and other intellectual property rights under the law. Content is provided to you on an "AS IS" basis. You may access Content for your information and personal use solely as intended through the provided functionality of the Service. You shall not download any Content unless you see a "download" or similar link displayed by ThinkRight for that Content, and you shall not copy, reproduce, publish, adapt, distribute, transmit, broadcast, display, sell, license or otherwise exploit any Content without prior written consent.

You agree not to circumvent, disable or otherwise interfere with security-related features of the Service, or features that prevent or restrict use or copying of any Content.

You understand that when using the Service you will be exposed to Content from a variety of sources, and that ThinkRight is not responsible for the accuracy, usefulness, safety or intellectual property rights of such Content. You may be exposed to Content that is inaccurate, offensive, indecent or objectionable, and you agree to waive any legal or equitable remedies you may have against ThinkRight with respect thereto.

As a ThinkRight account holder you may submit text, likes and user comments. You understand that ThinkRight does not guarantee any confidentiality with respect to any Content you submit.

• You are solely responsible for your own Content and the consequences of submitting and publishing it. You affirm that you own or have the necessary licences, rights, consents and permissions to publish the Content you submit.
• By submitting Content you grant ThinkRight a worldwide, non-exclusive, royalty-free, sub-licensable and transferable licence to use, reproduce, distribute, display, publish, adapt, make available online and perform the Content in connection with the Service and ThinkRight's business, in any media format and through any media channel. The licences granted in user comments are perpetual and irrevocable.
• You agree that Content you submit will not contain third-party copyrighted material, or material subject to other third-party proprietary rights, unless you have permission from the rightful owner.
• You agree that you will not submit any Content contrary to applicable local, national and international laws and regulations.
• Offensive content: you may not use the app to send messages or content that are offensive or prohibited. You can "Report Abuse / Flag" the content, use the "Feedback" section within the application, or email us through the website. Our moderation team will act on the concern within 24 hours and may block users who do not comply with these terms and guidelines.

ThinkRight does not endorse any Content submitted to the Service by any user, or any opinion, recommendation or advice expressed therein, and expressly disclaims liability in connection with Content. ThinkRight will remove Content if properly notified that it infringes another's intellectual property rights, and reserves the right to remove Content without prior notice.

ThinkRight will terminate a user's access to the Service if, under appropriate circumstances, the user is determined to be a repeat infringer. ThinkRight also reserves the right to decide whether Content violates these Terms for reasons other than copyright infringement — such as pornography, obscenity or excessive length — and may at any time, without prior notice and in its sole discretion, remove such Content and/or terminate the account that submitted it.

You agree that your use of the Services shall be at your sole risk. To the fullest extent permitted by law, ThinkRight, its officers, directors, employees and agents exclude all warranties, express or implied, in connection with the Services and your use thereof, including all warranties about the accuracy or completeness of this site's content or the content of any linked sites. ThinkRight assumes no liability for any errors or inaccuracies of content, personal injury or property damage resulting from your access to and use of the Services, unauthorised access to our servers, interruption of transmission, bugs or viruses transmitted by any third party, or any loss or damage incurred as a result of the use of any Content made available via the Services.

ThinkRight does not warrant, endorse, guarantee or assume responsibility for any product or service advertised or offered by a third party through the Services, and will not be a party to or responsible for monitoring any transaction between you and third-party providers. As with the purchase of a product or service through any medium, you should use your best judgment and exercise caution where appropriate.

To the fullest extent permitted by law, in no event shall ThinkRight, its officers, directors, employees or agents be liable to you or any other person for any direct, indirect, incidental, special, punitive or consequential damages, losses or expenses resulting from errors or inaccuracies of content, personal injury or property damage, unauthorised access to our servers, interruption of transmission, bugs or viruses transmitted by any third party, or any errors or omissions in any Content — whether based on warranty, contract, tort or any other legal theory, and whether or not the Company is advised of the possibility of such damages.

Where warranties, disclaimers and conditions apply that cannot legally be excluded in your jurisdiction, ThinkRight limits its liability for any claims under those warranties or conditions to supplying you the Services again (or the cost of supplying you the Services again). You specifically acknowledge that ThinkRight shall not be liable for the defamatory, offensive or illegal conduct of any third party.

The Service is controlled and offered by ThinkRight from its facilities in India. ThinkRight makes no representation that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless ThinkRight, its parent corporation, officers, directors, employees and agents from and against any claims, damages, obligations, losses, liabilities, costs and expenses (including attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including any copyright, property or privacy right; or (iv) any claim that your Content caused damage to a third party. This indemnity shall survive even if you cease to be a user of ThinkRight.me.

You affirm that you are more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into and comply with these Terms. In any case, you affirm that you are over the age of 13, as the Service is not intended for children under 13. Our Services are not directed to persons under 13; if ThinkRight becomes aware that a child under 13 has provided us with personal information, we will take steps to remove that information and terminate the account.

Your subscription plan will automatically renew through your app store account. Subscriptions may be managed by you and auto-renewal may be turned off in your account settings after purchase. Your cancellation request will be effective from the next billing cycle. After cancelling, you will be able to use your subscription for the remaining days you have already paid for; when it expires it will not be renewed. Cancelling your subscription will not retroactively refund subscription payments.

These Terms, and any rights and licences granted hereunder, may not be transferred or assigned by you, but may be assigned by ThinkRight without restriction.

You agree that the Service shall be deemed solely based in India and shall be deemed a passive website that does not give rise to personal jurisdiction over ThinkRight in jurisdictions other than India. The laws of India will apply to these Terms. For any dispute arising out of or related to the Service, the parties consent to personal jurisdiction in, and exclusive venue of, the courts in Mumbai, India. These Terms, together with the Privacy Policy and any other legal notices published by ThinkRight, constitute the entire agreement between you and ThinkRight concerning the Service. If a particular term is unenforceable, this will not affect any other term, and no waiver of any term shall be deemed a further or continuing waiver.
